1. Acceptance of Terms

By downloading, installing, accessing, or using the Cruxly AI Quiz mobile application ("App") or any related services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or Services.

These Terms constitute a legally binding agreement between you and Cruxly ("Company," "we," "us," or "our").

2. Eligibility

2.1 Age Requirements

• You must be at least 13 years old to use this App.
• If you are under 18 years old (or the age of majority in your jurisdiction), you must have parental or guardian consent to use the App.
• By using the App, you represent and warrant that you meet these eligibility requirements.

2.2 Account Registration

• You may need to create an account to access certain features.
• You agree to provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.

3. Description of Services

3.1 Core Features

Cruxly AI Quiz provides:

• AI-powered quiz generation from images of educational materials
• Study tools including flashcards and practice quizzes
• Progress tracking and analytics
• Export functionality to various formats (PDF, Anki-compatible files)

3.2 AI-Generated Content

• Quizzes are generated using artificial intelligence based on your uploaded content
• AI-generated content may contain errors or inaccuracies
• You are responsible for reviewing and verifying the accuracy of generated quizzes
• We do not guarantee the educational value or correctness of AI-generated content

4. Subscription Plans and Payments

4.1 Subscription Tiers

• Free Tier: Limited features with usage quotas
• Student Plan: Enhanced features for students
• Pro Plan: Full access to all features

4.2 Billing and Renewal

• Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions through your device's app store settings

4.3 Refunds

• Refund requests must be directed to Apple App Store or Google Play Store
• We do not directly process refunds for in-app purchases
• Refund policies are subject to the respective app store's terms

5. User Content and Intellectual Property

5.1 Your Content

• You retain all rights to content you upload ("User Content")
• By uploading content, you grant us a limited license to process, analyze, and generate quizzes from that content
• This license is solely for the purpose of providing the Services to you

5.2 Acceptable Use

You agree NOT to upload, share, or use the App to process:

• Copyrighted materials you do not have rights to use
• Content that violates intellectual property rights of others
• Obscene, pornographic, or sexually explicit material
• Content depicting or promoting violence, abuse, or illegal activities
• Malware, viruses, or malicious code

5.3 Copyright Responsibility

• You are solely responsible for ensuring you have the right to use uploaded content
• Uploading copyrighted textbooks, published materials, or other protected works without authorization may violate copyright law
• We are not responsible for copyright infringement committed by users
• We will respond to valid DMCA takedown requests

6. Export and Watermarking

• Exported files (PDF, Anki decks) are for your personal, non-commercial use
• Exported content includes watermarks identifying the licensed user
• You may NOT sell, commercially distribute, or publicly share exported quizzes
• You receive a personal, non-exclusive, non-transferable license to use generated quizzes

7. Device and Session Limits

Your subscription includes limits on simultaneous device usage:

• Free: 1 device
• Student: 2 devices
• Pro: 3 devices

• Logging in on a new device may automatically sign out the oldest session
• Accounts are for individual use only
• Sharing login credentials with others is prohibited

8. Disclaimers

Educational Disclaimer

• The App is a study aid, not a replacement for professional education
• We do not guarantee improved academic performance
• AI-generated quizzes may contain errors and should be verified

9. Limitation of Liability

We are not liable for indirect, incidental, special, or consequential damages, lost profits, data, or business opportunities, damages arising from your use of AI-generated content, or service interruptions or data loss.

10. Account Termination

By You

• You may delete your account at any time through the App settings
• Deleting your account will remove your data from our systems
• Subscription cancellation is separate from account deletion

By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or abusive behavior
• Misuse the App or Services
• Fail to pay for subscriptions

11. Dispute Resolution

• These Terms are governed by the laws of the State of California, United States
• Before filing a legal claim, you agree to try to resolve disputes informally by contacting us
• Any disputes not resolved informally shall be settled by binding arbitration

12. App Store Compliance

Apple App Store

• These Terms are between you and Cruxly, not Apple
• Apple has no obligation to provide maintenance or support
• Apple is not responsible for product warranties or claims
• Apple is a third-party beneficiary of these Terms

Google Play Store

• These Terms are between you and Cruxly, not Google
• Google has no obligation to provide maintenance or support
• Google is not responsible for product warranties or claims

13. General Provisions

• These Terms, together with the Privacy Policy, constitute the entire agreement between you and Cruxly
• If any provision is found unenforceable, the remaining provisions will continue in effect
• Failure to enforce any right or provision is not a waiver of that right
• We may update these Terms at any time
• Continued use after changes constitutes acceptance
